1. Overview & Definitions

These Terms of Service (“Terms”) govern your access to and use of the online service that prepares passport/ID photos and other document photos using automated tools and algorithms (“Service”). The Service is operated at passport-photos.net and may be offered through mobile or other interfaces.

Provider / Company / we / us — the operator of passport-photos.net.
User / you — any person who accesses or uses the Service.
Account — a user panel that may be created to access features.
Digital Content — output image files delivered in electronic form only.
Output — any image/file generated by or through the Service (including AI-assisted features).

By accessing or using the Service, you agree to these Terms. If you do not agree, do not use the Service.

3. What We Do (Services)

The Service lets you upload a photo and have it automatically processed (e.g., background cleanup, cropping, head-size/eye-level checks, resizing to specified dimensions) to create a photo formatted for common documents (e.g., passports, visas, IDs, driver’s licenses, school IDs). Exact parameters may vary by document and issuing authority.

4. Eligibility & Accounts

You must be at least 13 years old to use the Service. If you are under 18 (or the age of majority in your jurisdiction), you may use the Service only with parental/guardian consent.
You are responsible for your Account credentials and all activity under your Account.
You represent that you have all rights necessary to upload and process the photos you submit.

5. Your Content & Limited License to Us

Ownership. You retain all rights to photos you upload.
License to process. You grant us a non-exclusive, worldwide, royalty-free license to host, store, process, transform, transmit, and display your photos and Output solely to provide the Service, comply with law, prevent abuse, and handle support/quality issues.
Retention. We may store uploads and Output temporarily for processing and quality, and longer as permitted or required by law (see Privacy Policy).

6. Prohibited Uses

Do not upload illegal content, hate/violence, pornography, or third-party sensitive data without consent.
Do not infringe anyone’s IP rights or violate privacy or publicity rights.
Do not attempt to reverse engineer, disrupt, overload, or misuse the Service.

7. Prices, Currency & Payments

Prices are shown in USD unless otherwise stated and may change at any time before purchase.
Payment is processed by third-party payment processors; additional bank or processor fees may apply.
Taxes may be added as required by law.
Receipts/invoices are provided electronically.

8. Digital Delivery & Refunds

Upon successful payment, Digital Content is delivered electronically (e.g., download link and/or email). Processing typically begins immediately.

All sales are final once processing begins. Because we deliver customized Digital Content, refunds are generally not available. However, at our sole discretion, we may re-process or refund in limited cases (e.g., a technical error attributable to us). This paragraph does not limit any non-waivable rights you may have under applicable law.

9. No Government Affiliation; Acceptance Not Guaranteed

We are not affiliated with any government or issuing authority. Requirements for passport/visa/ID photos are set by third-party authorities and may change. We provide technical tools and rule-based checks to help format photos to commonly published standards, but we do not guarantee acceptance by any agency unless expressly stated in writing for a specific product. You are responsible for verifying up-to-date requirements with the relevant authority.

10. Intellectual Property; DMCA

The Service, including software, UI, text, graphics, and trademarks, is owned by us or our licensors and protected by IP laws. Except for your photos and Output (subject to Section 5), you may not copy, modify, distribute, or create derivative works without permission.

DMCA Notices. If you believe content infringes your copyright, send a notice to [email protected] with: (i) your signature; (ii) identification of the work and the allegedly infringing material; (iii) your contact info; (iv) a statement of good-faith belief; and (v) a statement under penalty of perjury of accuracy and authorization. We may remove or disable access per the DMCA.

11. Third-Party Services

We may integrate third-party services (e.g., hosting, analytics, payments). We are not responsible for third-party services and your use of them may be governed by their terms and privacy policies.

12. Warranties Disclaimer

TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE SERVICE AND ALL OUTPUT ARE PROVIDED “AS IS” AND “AS AVAILABLE,” WITH NO WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, NON-INFRINGEMENT, ACCURACY, OR RELIABILITY. AI/ALGORITHMIC FEATURES MAY BE IMPERFECT OR INACCURATE, AND RULES FROM AUTHORITIES MAY CHANGE WITHOUT NOTICE.

13. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, IN NO EVENT WILL WE BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR LOST PROFITS, LOST DATA, OR BUSINESS INTERRUPTION, EVEN IF ADVISED OF THE POSSIBILITY. OUR TOTAL LIABILITY FOR ANY CLAIM ARISING OUT OF OR RELATING TO THE SERVICE SHALL NOT EXCEED THE AMOUNT YOU PAID TO US FOR THE SERVICE THAT GAVE RISE TO THE CLAIM IN THE 3 MONTHS PRECEDING THE EVENT, OR USD $100, WHICHEVER IS GREATER. SOME JURISDICTIONS DO NOT ALLOW CERTAIN LIMITATIONS; SOME OF THE ABOVE MAY NOT APPLY TO YOU.

14. Indemnification

You agree to indemnify and hold us harmless from any claims, losses, liabilities, damages, and expenses (including reasonable attorneys’ fees) arising from your use of the Service, your content, or your violation of these Terms or applicable law.

15. Privacy & Cookies

Your use of the Service is also governed by our Privacy Policy. Where required, we obtain your consent for non-essential cookies.

16. Changes to the Service & to these Terms

We may modify or discontinue the Service in whole or in part at any time. We may update these Terms by posting a revised version with a new “Last updated” date. Changes become effective upon posting unless stated otherwise. Your continued use after changes means you accept them.

17. Governing Law; Dispute Resolution; Arbitration; Class-Action Waiver

Governing Law. These Terms are governed by U.S. federal law and the laws of the State of Delaware, without regard to conflict-of-laws rules.
Binding Arbitration. Any dispute arising out of or relating to these Terms or the Service shall be resolved by final and binding arbitration administered by the American Arbitration Association (AAA) under its Consumer Arbitration Rules. The place of arbitration is the United States (virtual/remote hearings permitted). The arbitrator may award individual relief permitted by law.
No Class Actions. Disputes must be brought on an individual basis; class, collective, or representative actions are not permitted.
Opt-Out. You may opt out of arbitration within 30 days of first agreeing to these Terms by emailing [email protected] with subject “Arbitration Opt-Out.”
Small Claims & Injunctive Relief. Either party may seek relief in small claims court for qualifying matters and may seek injunctive relief for IP or security issues.

18. Miscellaneous

Entire Agreement. These Terms plus any product-specific terms constitute the entire agreement between you and us regarding the Service.
Severability. If any provision is unenforceable, the remainder remains in effect.
No Waiver. Our failure to enforce a provision is not a waiver.
Assignment. You may not assign your rights; we may assign in connection with a merger, acquisition, or sale of assets.
Electronic Communications. You consent to receive communications electronically (e.g., emails, in-product notices).
